Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: 15 EX. CIVIL 700/23 Mittal Finsec Vs. Babita Devi Present: Ld. counsel for DH, Ms. Bharti through VC. Ld. LAC for JD, Sh. Varun Gupta along with JD. Matter is fixed today for further proceedings. It is submitted by Ld. counsel for DH that matter has been settled between the parties vide settlement agreement dated 02.12.2025 ,however, JD is unable to make payment as per settlement. It is submitted by Ld. counsel for JD that some more time may be granted to JD for making the payment. Perusal of the settlement agreement reveals that JD had undertaken to make payment of first installment of Rs. 40,000/- on 07.02.2026 and the next installment was to be paid by 07.03.2026, however, no payment has been made till date. Accordingly, the settlement agreement dated 02.12.2025 stands forfeited. Warrants of attachment of movable property be issued against the JD as per list attached on filing of PF, as per rules. DH is directed to appear for appointment of Bailiff on 10.04.2026 at 2.00 PM before Ld. ACJ and to Report before this Court on 30.05.2026. DH is also directed to file an affidavit stating therein that there is no stay on the execution petition alongwith the PF, if not filed earlier.
