Matter is fixed today for consideration on application u/o
6 Rule 17 of CPC filed on behalf of the plaintiff.
Submissions heard. Record perused.
Perusal of record reveals that the present matter is still at
the pre-summoning stage as the defendant is yet to be summoned.
The proposed amendment is in the nature of alteration of relief sought
due to change in circumstances after filing of the present suit.
Since the summons are yet to be issued in the present
case, no prejudice would be caused, if the application u/o 6 Rule 17 of
CPC is allowed.
In view of the averments made in the application and the
submissions advanced, application u/o 6 Rule 17 is hereby allowed.
Amended plaint be taken on record.
Issue summons of the suit to defendant on filing of
PF/RC/Speed Post/Courier, as well as through all electronic modes,
returnable on 16.04.2026.
Steps be taken within 15 days.
