Part arguments have been heard on the
application U/o 39 rule 1 and 2 CPC.
During the course of the argument it has
emerged that though plaintiff has claimed itself to be
partnership firm, there is no document on record to show if it
is registered with the Registrar of Firm. It has also surfaced
that the resignation letter of the defendant no.1 was accepted
by one AIMLAY Pvt. Ltd. and the resignation letter, at the
bottom mentions AIMLAY Pvt. Ltd. (Formerly Worldstar).
On inquiry, it is stated that Worldstar and AIMLAY Pvt. Ltd.
are distinct entity and are operating independently and the
resignation was accepted as the employees of both i.e. the
firm and company were same.
Cosidering the submissions made, the plaintiff
is directed to furnish an affidavit regarding area of operation
of plaintiff firm and AIMLAY Pvt. Ltd. and to clarify as to
why the company i.e. AIMLAY Pvt. Ltd. is portrayed as
“Formerly Worldstar”.
