In the present suit, the right of the defendants to file
WS was closed on the LDOH.
The plaintiff in the present case has sought a relief
of declaration to the effect that they be declared owner of the suit
property as well as cancellation of documents which might have
been created by the defendants.
Despite inquiry, the plaintiff has not clarified as to
what documents have been made/created by the defendants. The
valuation for the purpose of jurisdiction with respect to the relief
of declaration has not been mentioned properly as in para no.16 of
the plaint, the suit has been valued at Rs.53/-. It is stated by Ld.
Counsel for plaintiff that the plaintiff is in the possession of the
suit property and accordingly the valuation has been done. As per
volume 1, chapter III, part C rule 7 of Delhi High Court Rules, in
suit for declaration without consequential relief in respect of
immovable property, the valuation for the purpose of Suits
Valuation Act 1887 shall be the market value of the property in
dispute on the date of institution of the suit.
Accordingly, the plaintiff is directed to rectify the
valuation for the purpose of jurisdiction within two weeks from
today.
Be put up for further proceedings on 19.05.2025.
