LR Sumitra and Amita of deceased D-1 on behalf of themselves as well as Sonit Saini. D-2 in person. Application u/o 32 CPC was filed for appointment of LR Sumitra as the guardian of LR Sonit Saini on the ground of his mental unsoundness. Application not opposed. Allowed. Amended memo be filed in due course. WS filed on behalf of the Lrs of D-1. Replica;tion also filed in respect thereof. The record shows that the suit has been filed by the children of the deceased daughter with regard to the property of the father of the deceased daughter. The predecessor in question had passed away in 1962. The daughter concerned had also passed away in 2002. The suit is based upon the amendment in HSA in 2005 regarding the creation of the co-parcernory in favour of the daughter. The counsel for the Lrs of D-1 states that the suit is not maintainable for the simple reason that the amendment of 2005 was prospective and also that the succession before 2005 in the Agricultural land had to take place as per DLR Act, not HSA. In the given circumstances, to come up for arguments on the maintainability of the suit on 08.04.2026. (Sidharth Mathur) District Judge-01(N)/Rohini Courts Delhi/ 18.12.2025 -- 1 of 1 --
