It is stated on behalf of the plaintiffs that they are
giving up their rights in the agricultural lands as mentioned in
para 7 (I) and (II) of the plaint in view of the judgment of the
Supreme Court dated 20.09.2022 passed in “Har Naraini Devi
and ors Vs. Union of India and ors”. Accordingly these suit
properties are deleted from the plaint. The remaining suit
properties falls in Lal Dora wherein the plaintiffs prima facie
have a right of succession in terms of the amendment of 2005
made in section 6, HSA, as held in “Poonam Vs. Dharmender and
ors” 2025 SCC (online) Delhi 5967.
The plaintiffs shall now filed the amended plaint by
deleting the agricultural lands. To come up for filing of the
amended plaint on 29.07.2026.
