Notice to defendant no.2 again received back unserved.
However as per report summons to defendant no.2 has been
served by electronic mode by WhatsApp no. 9351114065, stated
to be of defendant no.2. Counsel for the plaintiff is directed to
furnish the affidavit regarding the above said WhatsApp number
to be belonging to defendant no.2 in terms of Rule 12 of Delhi
Courts (Service of Process by Courier, Fact, Electronic Mail
Service Civil Proceedings), Rules 2010. It is thereupon this court
would conclude regarding due service of summons.
On the last date of hearing on behalf of defendant no.1 WS
was filed, however same was though supported with the
statement of truth, affidavit of admission/denial. Since certain
additional documents of plaintiff were allowed to be taken on
record vide order dated 11.03.2026, therefore liberty was given to
defendant no.1 for filing additional WS/affidavit of admission/
denial regarding those additional documents.
Counsel for defendant no.1 submits that though he had e-
filed the amended WS but seeks one week’s time for filing the
proper affidavit of admission/denial regarding additional
documents of plaintiff allowed to be taken on record.
Put up this case for filing of affidavit of admission/denial,
affidavit of plaintiff as well as for arguments on application

under Order 1 Rule 10 CPC moved on behalf of defendant no.1
for 08.06.2026.
