Present: Sh. Saurabh Kumar Kaushik, counsel for plaintiff.
Ms. Dezy Rekha, counsel for defendant.
Heard. Perused.
Fresh vakalatnama filed on behalf of defendant.
Same be taken on record.
Counsel for the plaintiff submits that defendant has
encroached upon 25 sq. yds. out of his plot measuring 225 sq.
yds.
On the other hand counsel for defendant submits that
defendant has not encroached even upon a single inch of land of
plaintiff.
Counsel for plaintiff submits that Local
Commissioner may kindly be appointed to inspect the plot of
plaintiff as well as of defendant and also to measure them to find
out encroachment.
Counsel for defendant submits that she has no
objection to the same.
In view of aforesaid facts and circumstances, I
hereby appoint Sh. Devender Singh, Advocate, who is present in
court (Enrl. No. D/4400/2022, Chamber No. 91, Civil Wing,
Civil Side, Tis Hazari Courts, Delhi, Mobile No. 9911226011) as
Local Commissioner. The fee of the Local Commissioner shall be
Rs.20,000/- (Rupees Twenty Thousand Only) which shall be
borne by the plaintiff and be paid in advance by the plaintiff to
the Local Commissioner against proper receipt.

Local Commissioner is directed that after receipt of
the fee of Rs.20,000/- (Rupees Twenty Thousand Only) against
receipt, he shall inspect the plot of plaintiff as well as of defenant
on 18.05.2024 at 11.00 AM. The Local Commissioner is also
directed to measure the plot of plaintiff as well as of defendant in
presence of both the parties/their counsel(s). Local
Commissioner is further directed to state in the report about the
fresh/new construction carried out by any of the parties. Local
Commissioner is directed to file his report within 10 days from
the date of visit of the properties.
Copy of order be given dasti to all the parties as well
as to local commissioner.
Copy of plaint and documents annexed with it be
also supplied to local commissioner for identifying/visiting the
properties in question.
Now to come up on 01.06.2024 for further
proceedings, as per law.
