Perusal of the record reveals that in the present case,
issues were settled by the court vide order dated 20.03.2019 and
subsequently additional issues was also framed on 22.08.2023
and matter is now at the stage of P.E.
Perusal of the record further reveals that on LDOH,
the aspect of clubbing of the present case with the connected file
between the parties bearing no CS DJ No. 823/22 titled as Naresh
Kumar Vs Sushil Goel was kept for consideration for today.
I have heard the submissions of Ld Counsels for the
parties. Though the suit property in both the cases is same,
however, different reliefs have been sought by the parties.
Therefore, I find no reasons to club the cases as the same would
delay the trial in both the cases However, parties are at liberty to
apprise the court at the time of final adjudication regarding the
commonality of the suit property involved in both the present
cases.
List of witnesses filed by the plaintiff is already on
record.

At request of Ld Counsel for the defendants, let the
same be supplied again to them during the course of day.
List the matter for P.E on 04.11.2025.
Ld. Counsel for plaintiff is directed to supply
advance copy of the evidence affidavit to counsels for defendants
at least 10 days prior to NDOH.
