Perusal of the record reveals that there are some
applications pending namely application u/s 151 CPC,
application u/O 1 Rule 10 CPC, application u/O 39 Rule 1 & 2
CPC, application u/O 26 Rule 9 and application u/O VII Rule 14
of CPC.
On the last date of hearing, last opportunity was
granted to all the parties to file any pending replies, if not filed.
No replies filed. Accordingly, right to file reply stands close.
Arguments on application u/s 151 CPC alongwith
application u/O 1 Rule 10 CPC heard. Upon query by this court
from the Ld. Counsel for applicant as to how the present
application is maintainable when the applicant has already
withdrawn application u/O 9 Rule 13 and the applicant is neither
party to be made.
At this stage, Ld. Counsel for the plaintiff sought
some time to file relevant judgment in this regard.
