None has appeared on behalf of defendant since
morning despite repeated calls. Same was the case on the last
date of hearing. The defendant is well aware about the instant
matter because he had appeared on 19.01.2026 and given an
undetaking that he would make the payment of Rs.30,000/- to the
plaintiff.

In view of the above, clearly the defendant is not
interested in pursuing the present case. The defendant has failed
to file WS in the instant matter and the time limit of 90 days
since the date of receiving summons has already expired. In view
of the same, the defence of the defendant is stuck off.
Pleadings are complete.
Plaintiff is directed to file evidence by way of
affidavit alongwith list of witnesses on or before next date of
hearing.
