WS alongwith supporting affidavit alongwith an
application for condonation of delay has been filed on behalf of the
defendant. Copy supplied.
Arguments have been heard on the condonation
application. Record has been perused.
There is a delay of approximately 65 days in filing of the
WS. The reason for the delay mentioned in the application is that the
son of the defendant was sick and he could not approach the counsel
in time due to a strike of counsels on the court date. No medical
documents have been annexed alongwith the application in support of
the submissions. Further, a strike on the court date does not justify
approaching the counsel late or filing the WS late.
Despite the same, in the interest of justice, the
application is allowed and the delay in filing of the WS is condoned.
Accordingly, the WS is hereby taken on record. However, a cost of
Rs.1,000/- is imposed upon the defendant to be paid to the plaintiff on
the NDOH.
The plaintiff is directed to file replication, if any, with
advance copy to the opposite party before the NDOH.
Both the parties are directed to file affidavits of
admission-denial with advance copy to each other before the NDOH.
Be put up for completion of pleadings, admission-denial/
framing of issues on 12.07.2025.
