Present: Complainant with Ld. Counsel Sh. H. S. Solanki.
Accused in person.
Perusal of record shows that vide order dated
14.05.2024, Ld. Predecessor Court sentenced the convict Manindra
for imprisonment of SI for a period of five months and also to pay
a fine of Rs.4.50 lacs to the applicant/ complainant Dharmendra.
The said sentence was suspended for a period of 30 days under
Section 389 Cr.PC so as to enable the convict to file the appeal if
any against the said order. However, no appeal was preferred by
the convict and so NBWs were issued against the convict vide
order dated 29.08.2024. Also on the last date of hearing, the
convict remained absent and fresh NBWs were issued against
convict/ non-applicant Manindra through DCP concerned.
Today, convict has appeared and has submitted that he
has paid compensation amount of Rs.4.50 lacs to the complainant/
applicant. The said fact has been admitted by the applicant/
complainant. On enquiry, the convict has confirmed that no appeal
was preferred by him before Ld. Sessions Court/ Ld. Appellat
Court against the conviction/ order on sentence.
In view thereof, convict is taken into custody for
execution of order on sentence dated 14.05.2024. Custody warrants
be prepared.
At this stage, Sh. Ravi Kaushal, Ld. Counsel for
accused has appeared and has also submitted that no appeal was
preferred against the order on sentence dated 14.05.2024 of Ld.

Nothing remains to be done in this case.
Custody warrants be prepared. Application stands
disposed off accordingly.
File be consigned to record room after due
compliance.
