1. Defendants have moved IA No. 1/26 U/S 151 CPC seeking
compliance of order dated 24.03.2025. Copy supplied.
Arguments heard.
2. Counsel for defendants submit that vide order dated 24.03.2025,
following directions were given to plaintiff:-
9. Accordingly present application is disposed off by allowing
defendant to call upon the plaintiff to produce balance sheets
for the period from 31.03.2011 to 31.03.2024 of M/S Lucky
Stationary Mart.
10. Needless to say that in case the aforesaid balance sheets are
not in possession of plaintiff, she may say so in writing while
answering the said interrogatories.
3. It is submitted on behalf of defendants that the balance sheets
supplied to defendants in terms of the above order only pertain
to year 2022 to 2024 and not for the entire period of 31.03.2011
to 31.03.2024.
4. Per contra, Counsel for plaintiff submits that she only has
possession of balance sheets for the above three years only and
does not have possession for the period prior to 2022. Para 10
of order dated 24.03.2025 specifies what needs to be done by
the plaintiff if she does not have copies of balance sheets
directed to be produced in terms of para 9 of order dated

24.03.2025. Admittedly, no written reply has been filed by
plaintiff and thus, counsel for defendants is correct to contend
that order dated 24.03.2025 has not been complied for close to
18 months. Perusal of record shows that multiple dates were
given at the instance of plaintiff to allow compliance.
5. Thus, subject to cost of Rs. 20,000/- to be paid to defendants,
one final opportunity is granted to the plaintiff to fully comply
with order dated 24.03.2025 within 7 days from today.
Application is disposed off.
6. List for confirmation of compliance of order dated 24.03.2025
and for PE on 28.01.2027.
7. Date of 17.09.2026 is cancelled.
