R-4/Sudesh is described as deceased. His LRs are stated
to be already impleaded as R-5 to R-7. No petition can lie against a
dead persons and thus, R-4 is deleted from the array of parties.
Petitioner, without changing the serial number of the
parties in the original memo, is directed to file a fresh memo.
On filing of original Will in question and an amended
memo, issue notice of the present petition to the respondent(s) through
all permissible modes, on filing of PF. Let valuation report be called
from SDM concerned for next date.
Notice be also given to the persons having caveatable
interest in the property covered under the Will in question, by way of
publication in newspapers ‘Virat Vaibhav’ and ‘Statesman’ on
deposition of publication charges by the petitioner. Let PF be filed.
