Sanjeet Singh and Sh. Akshay Sinha, Counsels for defendant through VC. Perusal of record shows that status report was filed on behalf of defendant on the last date of hearing. Plaintiff states that he has copy of the report and as per the said status report, the defendants are trying to delay the referendum and thereby the consequent elections. He submits that the defendant may be directed to hold the referendum in January 2026 so that the elections can proceed as per the tentative schedule. Counsel for defendant Sh. Aditya Panda, submits at bar that as per instructions received, the referendum would be held tentatively on 25.01.2026 and the said statement at bar would meet the contention of the plaintiff. Plaintiff states that in view of the said submission being made at bar, date in the month of February may be given for ensuring compliance of the same. Counsel for defendant states that defendant has no objection in this regard, however, the suit has become infructuous since the same was filed with respect to notice dated 04.12.2024 regarding the convening of AGM which has already been held in pursuance of order dated 21.02.2025 and therefore, nothing remains to be adjudicated in the present matter.
