Present: Sh. Sumit Sharma, Ld. counsel for the complainant.
None for accused.
Ld. counsel for the complainant submits thathe has filed the tracking report of
the delivery of the summons on the e-mail ID of the court. Same be taken on record.
Physical copy of the same be furnished within due time.
Reader is directed to upload the same on LAYERS as per rules.
Perusal of the tracking report shows that summons are duly served on the
accused. Despite service, none appeared on behalf of accused. It appears that accused is
deliberately/intentionally not appearing before this court.
Accordingly, issue BWs against accused no.2 (Proprietor) in sum of
Rs.20,000/- with one surety through SHO concerned, on filing of PF by the complainant
within 7 days, returnable for the NDOH.
The concerned SHO is directed to effect the service of the warrants positively
by atleast making 3 attempts for executing the same.
Put up for report/appearance of accused and further proceedings on
19.09.2024.
PA is directed to do updation of the case and upload the order as per rules.
