Present: Ms. Shipra Chaudhary, Ld. counsel for the complainant.
None for accused.
NBWs received back unexecuted with the report “premises locked (1st
address) & no such person (2nd address)”.
Ld. counsel for the complainant submits that accused has failed to pay the
previous cost imposed on him.
Accused was absent even on LDOH.
And today, matter has been taken up twice, however, no one has appeared on
behalf of accused.
The report is perused. It is apparent that the accused is evading his arrest and
due execution of warrants. In view of above, process U/S 82 Cr. P.C. be issued against the
accused on filing of PF within 07 working days:
1. By reading the proclamation in conspicuous place of town.
2. By way of affixation in conspicuous part of the house.
3. By way of affixation in some conspicuous part of the court.
The process be directed to be executed at least 30 days before the NDOH fixed
in the matter and concerned Process Server be directed to appear on NDOH for recording of
his statement in that regard.
Fresh notice be also issued to surety to appear and showcause why his bonds
shall not be forfeited.
Let court notice be issued to him to appear before this court on NDOH.
Put up for further proceedings on 08.08.2024.
PA is directed to do updation of the case and upload the order as per rules.
