Perusal of the case documents reflects that the drawer of the
cheques in dispute is Man Bahadur whereas the sole proposed accused herein is
Mrs. Meena and all the documents on record bears the name of Mrs. Meena.
Ld. counsel is directed to apprise how this complaint is maintainable against the
proposed accused.
At this stage, Ld. counsel submits that he is suffering from viral and
he does not have the case file with him today. He requests for one more
opportunity to address arguments.
In the interest of justice, one more opportunity is given for address
arguments failing which the complaint will be dismissed as not maintainable.
