At the outset, Ld. Counsel of DH, on instructions
states at Bar that in view of the fact that DH herein has already filed
its claim before IRP, DH wishes to withdraw the present execution
petition, without prejudice to its right to file fresh execution, if so
required, in accordance with law.
Separate statement of counsel of DH is recorded in this
regard.
DH shall remain bound by the statement made today on
its behalf by its counsel.
Having considered the submissions made on behalf of
both the sides and in view of statement recorded today, and keeping
in view overall facts and circumstances of the case, the present
execution petition is dismissed as withdrawn. However, withdrawal
of present execution petition shall not be preclude the right of DH to
take recourse to appropriate remedies, if any, as may be available
under the law.
File be consigned to record room, after due
compliance.
