checked and registered.
Present: Appellant Anita is present in person.

Heard. Record perused.
This is an appeal u/s 374(3) CrPC against the judgment dated
12.05.2023 and order on sentence dated 15.05.2023 passed by the court of Sh.
Harjot Singh, Ld. MM(NI Act), New Delhi whereby the appellant has been
convicted for commission of offence u/s 138 of Negotiable Instrument Act.
An application u/s 389 Cr.PC praying for suspension of the
sentence and grant of bail is also filed by the appellant.
The appellant is convicted for commission of the offence u/s 138
of the Negotiable Instrument Act which is bailable in nature. The appellant
remained on bail during the trial. Therefore, considering the facts and
circumstances the application u/s 389 Cr.PC moved by the appellant is allowed.
The appellant/convict is admitted to bail on furnishing the bail bond in a sum of
Rs.20,000/- along with one surety in the like amount to the satisfaction of the
Ld. Trial court. The sentence imposed by the Ld. Trial court shall remain
suspended till the disposal of the present appeal.
This is an appeal by the drawer against the conviction u/s 138 of
the Negotiable Instrument Act, therefore, u/s 148 of the Negotiable Instrument
Act, the appellant is directed to deposit 20% of the compensation amount in
dispute within 30 days from today.
The application u/s 389 CrPC filed by the appellant/convict is
disposed of accordingly.
Trial Court record be summoned for next date.
Notice of appeal be also issued to the respondent by all
prescribed modes on taking steps for next date.
Put up for arguments on the appeal on 05.09.2023. Copy of this
order be given dasti to Ld.counsel for appellant, as requested.
