Counsel for defendant has filed counter-claim alongwith an application U/o XXXIX Rule 1 & 2 CPC. Ld. Counsel for defendant submits that application moved by plaintiff U/o XXXIX Rule 1 & 2 CPC and the present application under the same provision filed by defendant be heard together. At this stage, Ld. Counsel for plaintiff submits that defendant cannot be allowed to file counter-claim. Part submissions heard on this score. At this stage, Ld. Counsel for defendant further submits that defendant has already filed petition before the Hon’ble High Court seeking cancellation of registration of Copyright in favor of plaintiff. It has been further submitted that defenant has also moved an application for transfer of present suit to the Hon’ble High Court which is fixed for 11.12.2025. Ld. Counsel for defendant further submitted that arguments on the present application be heard after 11.12.2025. On the other hand, Ld. Counsel for plaintiff has strongly opposed the same.
