Ms. Swati Ahalawat, Ld.counsel for the revisionist present in
the court.
An application seeking exemption from filing the certified
copy of the impugned order dated 30.11.2023 filed.
Heard.
In view of submissions, application is allowed and the
revisionist is exempted to file certified copy of the impugned order.
This is the revision petition filed by the revisionist being
aggrieved by the order dated 30.11.2023 whereby the complainant’s
evidence was closed without giving the revisionist/accused an opportunity
to cross-examine the complainant witness.
It is admitted by Ld.counsel for revisionist that he had not
invoked the power of Ld. Trial Court under Section 311 Cr.PC.
In view of submissions made by Ld.counsel for revisionist,
the present revision petition against the impugned order dated
30.11.2023 is disposed off with liberty to the revisionist to approach the
Ld. Trial Court with an application under Section 311 Cr. PC. The Ld.
Trial Court shall dispose off the application under Section 311 Cr. PC
without being influenced by the disposal of present revision petition.
Revision petition stands disposed off accordingly.
File be consigned to record room after necessary formalities.
Copy of this order be sent to Ld. Trial Court and be also given
to the revisionist, as requested.
