Sh. Raahithya Raj Mishra, Ld. Counsel for defendants no.1 &
2 (through VC).
Amended memo of parties has been filed on behalf of the
plaintiff.
Ld. Counsel for defendants no.1 & 2 has moved an
application under Section 151 CPC alongwith copy of Board Resolution
and Vakalatnama seeking some time to file written statement. Defendant
was served on 09.06.2025, however, counsel for the plaintiff submits that
for expeditious disposal of the instant matter some time may be given to
the defendant to file written statement subject to cost.
In view of the above submissions, defendants are permitted to
file written statement within 10 days from today with advance copy to the
plaintiff subject to cost of Rs.15,000/- to be paid to the plaintiff.
Application is accordingly, disposed off.
Upon receipt of copy of written statement, plaintiff is at
liberty to file replication, if any thereafter.
Both the parties are directed to file their affidavit of
document admission/ denial before the next date of hearing after
exchanging the copy of the same amongst themselves.
Now to come up for replication, documents admission/ denial
and framing of issues in the instant matter on 16.12.2025.
