plaintiff through VC.
Mr. Vikram Gola, Ld. Counsel for the defendants
alongwith defendant no. 1 in person.
Vakalatnama is filed by Ld. Counsel for the defendants. He
submits that he is appearing also on behalf of defendant no. 2 and
will file vakalatnama executed by defendant no. 2, by the next
date of hearing.
He submits that he has instructions to state that the
defendant no. 2 turned 18 years of age in February, 2025.
Ld. Counsel for the plaintiff submits that in view of the
said submissions of the Ld. Counsel for the defendants, his
application under Order 32 Rules 2 & 3 of CPC be dismissed as
infructuous.
In view of the above submissions, the above application of
the plaintiff is dismissed as the defendant no. 2 has attained 18
years of age and is not a minor.
Let written statement be filed within 30 days from today
after supplying advance copy to the Ld. Counsel for the plaintiff.
Let replication be filed within 30 days from receiving copy
of the written statement after supplying advance copy to the
Ld. Counsel for the defendants.

Ld. Counsel for the defendants submits that the defendants
undertake not to create third party interest in Flat no. 488, Second
Floor, Block D-5, Vasant Kunj, New Delhi, till next date of
hearing.
In view of the said undertaking, the said defendants are
restrained from creating third party interest in Flat no. 488,
Second Floor, Block D-5, Vasant Kunj, New Delhi, till next date
of hearing.
To come up for arguments on the application for interim
relief on 16.10.2025.
