Lawyers are abstaining from work today.
Present: Plaintiff in person.
Sh. Ankit Swamy Kashyap on behalf of NDBA for
the reasons that counsels are on strike.
Today, Sh. Sapna Jain is present on behalf of Canara
Bank. She is examined and discharged as PW2.
Further on the last date of hearing, Ld. Predecessor
of this Court has issued court notice to SDM, Collectorate
Office, Rajnagar Distt Centre Ghaziabad, Sadar, UP under order
XVI Rule 12 CPC as to why fine should not be issued upon him,
since despite repeated directions, he failed to furnish the
valuation report of the property.
Today, plaintiff has filed
dasti summons as per
which the notice was duly served upon the o/o SDM concerned,
however despite the same, none has appeared from his office nor
the valuation report filed. Considering the same, that the SDM
concerned is willfully disobedience of the order of this Court and
further despite repeated directions has failed to file the valuation
report or appear before this Court, the DM, District Ghaziabad is
directed to ensure compliance of order of this Court, failing
which he shall attached the salary of SDM concerned to the
extent of Rs.100/- and shall file the compliance report on the next
date of hearing. Let copy of this order be sent alongwith the
notice to DM Ghaziabad.
Now to come up on 03.11.2025.
