Briefly stated: The applicant herein has filed a suit
challenging a notice for cancellation of lease deed in favour the applicant,
which the DDA alleged to have been procured by fraud by plaintiff in
collusion with some DDA officials. Ld. Counsel for the DDA further
intimated the Court that the matter was referred to CBI. However,
subsequently, it appears that suit was withdrawn by plaintiff/ applicant.
The applicant has now moved the instant application for
return of the impugned lease deed. Accordingly, notice was issued to DDA
to apprise the Court about the pendency of CBI matter.
Ld. Counsel for respondent submits that since this is a very
older matter, he be given some time to assist the Court about the pending
CBI case particulars.
Ld. Counsel for the respondent prays for copy of the
application. Ld. Counsel for the applicant undertakes to supply the same
during course of the day against acknowledgment.
Now to come up for further proceedings in the instant matter
on 21.11.2025.
