Fresh Appeal under Section 9 of PP Act is received by way of
transfer. It be checked and registered.
Present : Sh. Rohit Sharma, Ld. counsel for appellant.
Heard.
The impugned order is dated 18.01.2024 vide which
the eviction under Section 5 (1) has been passed directing the
appellant to deposit Rs. 4,12,92,213/- within 30 days. Ld. counsel
for appellant submits that this premises is on lease with the
appellant for last more than 30 years. He submits that the dues
are calculated in a wrong manner by adding the service tax but as
per the lease deed, service tax was inclusive of the lease amount.
Ld. counsel for appellant admits that at present
outstanding dues of the appellant to the tune of the Rs. 2 crore
and he is ready to pay this amount subject to
settlement/reconciliation of accounts by the respondent on
installments. He submits that other connected matters of the
parties are listed for 15.02.2024.
In view of the facts and circumstances, operation of
the impugned order stands stayed. Notice be issued to the
respondent on filing of PF/RC on 15.02.2024.
