Fresh suit received by way of assignment. It be checked &
registered as per rules.
Present: Mr. Abhitesh Kumar, Ld. Counsel for the plaintiff.
Heard. Record perused.
It is stated by Ld. Counsel that for the loan in
question originally advanced in the year 2017, the defendant
subsequently also signed an acknowledgement of outstanding
debt in the year 2020. The defendant however failed to make
payment thereafter as well and in pursuance thereof, the present
suit has been filed. From the date of such acknowledgement, Ld.
Counsel seeks relaxation in the period of limitation for filing the
present suit on account of the period directed by the Hon’ble
Supreme Court of India to be excluded due to COVID pandemic.
Excluding such period, the suit is found to be filed within the
period of limitation. Ld. Counsel undertakes to file relevant order
passed by the Hon’ble Court on NDOH as well.
In view of the above, let summons be issued to both
the defendants on filing of PF / RC / through all prescribed
modes returnable for NDOH.
Re-list on 17.02.2025.
