On perusal of the case file, it is observed that the
matter is at the stage of consideration of the application under
Order 39 Rule 1 and 2 CPC on which arguments were heard. In
the meantime however, residence order has come to be passed by
the Ld. MM (Mahila Court) qua the same suit property. In such a
scenario therefore, there seems to be an apparent conflict
between the position as it stands in view of the order passed by
the Ld. MM (Mahila Court) on one hand and the relief of
injunction, interim or final, qua the same suit property filed by
the plaintiff.
In view of the above, both the sides are hereby
directed to file copies of authorities they wish to rely upon in this
regard specifically. They may be supplied to the opposing sides
as well at least a week prior thereto.
