Order Details: COPY OF ORDER Pdf Text: 5 Civ Suit 799/24 Farheen Vs. Sana @ Baby 10.07.2025 Present: Sh. Sachin, Ld. Counsel for plaintiff alongwith plaintiff. Defendant in person. Written statement alongwith supporting affidavit and condonation of delay application as well as reply to application under Order 39 Rule 1 and 2 CPC has been filed on behalf of the defendant. Copy supplied. There is a delay of approximately 33 days in filing of the WS. As per the condonation application, the delay was caused as there were chances of settlement between the parties. Ld. Counsel for the plaintiff submits that no efforts were made by the defendant to settle the matter and therefore, the delay in filing of the WS is unjustified. Heard. Record perused. In view of the facts and circumstances, the delay in filing the WS is hereby condoned and the WS is taken on record. Further, upon interaction with the parties, there appear to be elements of settlement in the instant case. Accordingly, the matter is referred to Mediation Cell, Karkardooma Courts, Delhi, on 25.07.2025 at 2:00 p.m to enable the parties to pursue settlement talks. Parties are directed to appear in person alongwith their counsels before the Mediation Cell, on the above said date and time. Ahlmad is directed to send the reference well in advance.
