Present: Sh. Harsh Gupta, Ld counsel for the plaintiff with plaintiff.
Sh. Ajay Chawla, Ld counsel for defendant no.1 and 2
(through VC).
Ld. counsel for the plaintiff submits that he does not wish to
file any reply to the application of defendant no. 1 and 2 for condonation of
delay in filing of WS and he is ready to straightway address his arguments.
Arguments heard on the application for condonation of delay in
filing of WS.
Without getting much into controversy, Ld counsel for the
defendant no.1 and 2 has submitted that the application may be allowed in
the interest of justice and Ld counsel for the plaintiff has also submitted that
the application, if allowed, the same should be subject to some costs.
Considering the submissions and the fact that some delay has
been occasioned due to conduct of defendant no.1 and 2 as well as
considering the period of delay, the application is hereby allowed subject to
cost of Rs 3,000/- to be paid by defendant no.1 and 2 to the plaintiff on the
next date. WS be taken on record subject to payment of cost.
Another application under Order 39 Rule 1 and 2 CPC made on
behalf of defendant no.1 and 2 after last date of hearing. Copy has been
supplied and acknowledged by Ld counsel for the plaintiff.
Let reply be filed by the plaintiff with advance copy to the
opposite party.
Put up for arguments on the applications under Order 39 Rule 1
and 2 CPC filed by plaintiff and defendant no.1 and 2 on 29.10.2026.
