Matter is taken up today via Video Conferencing, as per the
directions issued by Ld. Principal District & Sessions Judge, East,
due to floods in Delhi. Further, the undersigned resides in North Delhi
near Civil Lines (Kashmere Gate) and the route of undersigned is
water logged, therefore, it is not possible for the undersigned to
reach physically to the Court.
One of the Stenographer is on leave today.
Fresh suit received by way of assignment. It be checked
and registered.
Pr. Ld. Counsel for the plaintiff.
Ld. Counsel for plaintiff has made submissions and seeks ex
parte adinterim order restraining the defendants from conducting
unfair Elections of the Jai Ambey Apartments, New Kondli, Delhi
110096 on 16.07.2023 as per the Schedule decided by the
defendants.
Submissions heard. Considered and record perused.
On perusal of file, this court at this stage, does not deem it fit
to grant exparte adinterim order and furthermore, it appears that the
object of granting the injunction would not be defeated by the delay in
case notice of the application is issued to the opposite party, hence,
same is declined.
However, considering the submissions made by the counsel
for the plaintiff, let summons for settlement of issues and notice of
the application U/o 39 Rule 1 & 2 of CPC be issued against the
defendant(s) in all modes including Speed post and registered AD on
taking all appropriate steps in that respect by the plaintiff returnable
for 15.07.2023. At request, process be given dasti.
