Present: Sh. Chetanya Jain, Ld. Counsel for the plaintiff
through V/C.
Sh. Harish Gupta, Ld. Counsel for the defendant
through V/C.
The Ahlmad has filed the report stating that the
application under Order 12 Rule 6 CPC filed by the plaintiff is
not traceable till date despite best efforts. The Ahlmad is warned
and directed to ensure that all documents are properly tagged
with the judicial file at the correct place in future.
In view of the application being untraceable and to
avoid wastage of judicial time and there being no objection from
Ld. Counsel for defendant as the contents are not disputed, a
print out of the duly e-filed application be taken from CIS and
the same be tagged with the judicial file for consideration.
Further, ld. Counsel for the plaintiff submits that the
application for abandoning part claim could not be filed as the
plaintiff was out of station.
In view of the above submission, in the interest of
justice, one more opportunity is granted to the plaintiff for
pursuing his case.
Be put up for arguments on the application under
Order 12 Rule 6 CPC / further proceedings on 18.04.2026.
