Fresh suit received by way of assignment, it be checked and
registered as per rules.
Present: Ms. Nimisha Gupta and Sh. Bijesh Pandey, Ld.
Counsels for the plaintiff.
This is a suit filed for mandatory and permanent
injunction with an application u/O XXXIX Rule 1 & 2 read with
section 151 CPC. Also, an application under Section 80 (2) r/w
Section 151 CPC has been filed.
In view of the averments made in the application
and considering the nature of the reliefs sought, this court is
satisfied that urgent relief is prayed for, which cannot brook
delay. Accordingly, the requirement of issuance of notice under
Section 80 (1) CPC is dispensed with for the purpose of the
present proceedings.
Case file perused. Submissions heard.
Let summons be issued to all defendants alongwith
notice of the aforementioned application on filing of PF / RC /
through all prescribed modes returnable for NDOH.
