Fresh application u/s 175(3) r/w Section 223 BNSS received. It be checked and
registered as per rules.
Present: Sh. Rakesh Singh, Ld. Counsel for complainant.
Affidavit with respect to application U/s.175(3) BNSS filed by the
complainant. Submissions heard. Perused.
Notice be issued to the SHO concerned with direction to file a status
report/ action taken report stating and answering the following questions serial
wise:-
1. Whether any complaint had been made by the complainant in the police
station concerned or received from the concerned office of DCP or via e-mail/post?
2. If yes, whether any action has been taken by the police on the said
complaint? The action taken be provided in detail by the inquiry officer/ IO.
3. Whether any cause of action/offence(s) or any part of the cause of action or
any part of the offence(s) took place within the territorial limits of this PS? In case,
the answer is in the negative, whether any Zero FIR was registered and whether the
FIR or complaint was sent to concerned PS?
4. Whether the complaint received at the PS discloses commission of any
cognizable offence(s)? If yes, whether FIR was registered and action/inquiry
conducted as per the directions/ guidelines of the Hon'ble Supreme Court in Lalita
Kumari Vs. Govt. of UP (2014) 2SCC1?
5. Whether any action(as above) taken by the police on the complaint informed
to the complainant?
Complainant is directed to supply the copy of complaint to Court
Official/ Naib court concerned for handing over the same to SHO.
Be put up for filing of report and further proceedings on 21.01.2026.
Copy of this order be sent with the notice.
