Arguments heard. Record perused.
Brief facts mentioned in the application are that proposed
accused extended threats to the complainant to withdraw the pending
litigation between the complainant and the proposed accused. Proposed
accused further threatened the complainant to implicate him and his family
members in false cases. Complainant filed complaints with the PS concerned
and higher police authorities, but to no avail, hence the present application.
ATR has been called from the PS concerned, as per which, NCR
bearing no. 60/2025 has been registered with PS Preet Vihar.
In the case in hand, the identity of the proposed accused is
within the knowledge of the complainant. The CCTV footage of the alleged
incident is already in possession of the complainant. No evidence needs to be
collected at the hands of police. In the opinion of this court, no police
intervention is required. The application u/s 175(3) BNSS is accordingly
dismissed.
