Order Details: COPY OF ORDER Pdf Text: PC 56/23 SUNITI CHANDRA Vs. STATE 09.04.2026 Present : Mr. Rachit Gupta, Ld. counsel for petitioner along- with the petitioner/ PW1. The matter is fixed for PE. PW1 tendered her evidence by way of affidavit Ex.PW1/A. She is examined and discharged. Petitioner has moved an application u/s 151 CPC for summoning of offical witness. In view of the submissions made in the said application, the same is disposed of as allowed. Let witness mentioned in the aforesaid application be summoned on filing of PF for the next date of hearing. Steps be taken within one week from today. Another application u/s 151 CPC filed by the petitioner for recording of evidence of attesting witnesses of the Will in question by video conferencing or through Local Commissioner. Petitioner has also moved an application u/O XXVI Rule 9 CPC for appointment of Local Commissioner/ Receiver to prepare the inventory of the articles lying in Locker No. 37, Nainital Bank Ltd., I.P. Extension, Patparganj, Delhi in order to assess the values of the assets of the deceased, namely, Lt. Sheel Chandra. -- 1 of 2 -- In view of the submissions made in the aforesaid application, the same is disposed of as allowed and Ms. Isha, Advocate, Enrl No. D-5228/2020, Mob. No. 8929707170, is hereby appointed as Local Commissioner, who shall visit the abovesaid Bank within a week from today along-with petitioner/ counsel for petitioner wherein in his presence, the Bank Manager shall open the said locker and the Local Commissioner shall take photographs, prepare inventory of the articles and obtain photocopies of the documents, if any lying therein under the signatures of Bank Manager, petitioner and two independent witnesses. The articles lying in the said locker shall also be valued by the Government Approved Valuer at the expense of petitioner. The photography and videography of the proceedings shall also be conducted at the expenses of the petitioner at the spot. The fee of Local Commissioner has been fixed at Rs.20,000/- excluding out of the pocket expenses. Let commission be executed within a week from today and report thereafter be filed with copy to the petitioner.
