Present : Mr. Manu Gupta, Ld. counsel for DH along-with the
son of DH- Mr. Gagan Pahwa.
Ld. proxy counsel for JD.
Today again an application filed on behalf of the JD
seeking exemption from personal appearance of JD. The same is taken on
record and registered as IA no. 5/2026.
Perusal of the record shows that on 27.02.2026, JD
submitted before this Court that he is ready and willing to make the
payment of the remaining decreetal amount in installments and also
made a payment of Rs.35,000/- to DH and thereafter, on joint request of
the parties, matter was referred to mediation.
It is submitted by Ld. counsel for DH that said mediation
failed as the JD had not offered to make payment of decreetal amount.
Perusal of record further shows that since then JD has not
been appearing before this Court and on each date sought personal
exemption from appearing before this Court.
In view of the aforesaid facts and since no plausible
ground has been given in aforesaid application, the same is dismissed.
This Court is satisfied that JD is deliberately avoiding
payment of remaining decreetal amount despite his undertaking that he
would make the payment of same.
In view thereof, issue warrant of arrest against the JD to
executed through the concerned DCP on filing of PF and Subsistence
Allowance of one week for 07.08.2026.
Steps be taken within one week
from today.
