Counsel for DH along-with son of DH.
Ld. Counsel for JD along-with JD.
Ld. Counsel for DH submits that there is no bar in
law that a person more than 65 years of age cannot be confined to
civil imprisonment in execution proceedings.
Judgment titled as “Subhash Agarwal Vs. Abhishek
Andley & Ors.” passed by Hon’ble Delhi High Court filed by the
Ld. Counsel for DH. Taken on record.
I agree with the contentions of Ld. Counsel for DH.
It is further submitted by the Ld. Counsel for DH
that till date JD has not paid even a single penny to discharge his
liability under the decree in question.
It is also stated by the Ld. Counsel for DH that JD is
running a furniture shop in the name and style of Bittu Furniture
and therefore, he has adequate funds to pay the decretal amount,
however, JD is deliberately neglecting the payment of decretal
amount.
On the other hand, Ld. Counsel for JD submits that
the said shop belongs to the son of JD.
Ld. counsel for DH further submits that it is a joint
business of JD and his son and no document has been filed by the
JD which can prove that the business belongs only to the son of

JD. It is further submitted that pursuant to warrant of arrest, the
JD was arrested by the concerned Police Personnel from the said
shop only.
In view of the submissions made, this Court is
satisfied that JD is deliberately neglecting the payment of
decretal amount, therefore, he is taken into custody and
committed to civil imprisonment upto 27.02.2026 subject to
deposit of subsistence allowance, if not deposited, with directions
to the concerned Jail Superintendent to produce the JD before
this Court on 27.02.2026.
Copy of this order be given dasti to ASI Kehar
Singh, No. 7686DAP, ED Lockup, East, KKD, Delhi for
compliance.
