Proxy Counsel for defendant no.1, appearing through VC. Neither counsel for the defendant is present, nor the defendant is present. Perused the application under Order VI Rule 17 CPC, filed on behalf of defendant for amending WS, by adding verification clause. It is argued by Ld. Counsel for plaintiff that verification clause as asked to be amended by defendant is not as per law, hence, application should not be allowed. Since Proxy counsel appearing for the defendant today is not in a position to argue the application and counsel for defendant is not available. Considering the same adjournment is granted to the defendant subject to cost of Rs.1,000/- to be paid to the plaintiff. An application under Order XII Rule 6 CPC has also been filed on behalf of plaintiff. Copy placed on record be supplied to the defendant. Defendant is directed to file reply to this application by NDOH. If counsels for the parties will not be present in the Court for arguments on the NDOH, aforesaid applications will be considered on merits, without giving further opportunities for arguments. Put up for arguments on application under Order VI Rule 17 CPC of defendant & application under Order XII Rule 6 CPC of plaintiff and payment of cost by the defendant on 22.01.2024.
