Arguments on application under Order VI Rule 17 CPC

By way of this application, the defendant has sought to
add verification clause in the written statement, which was
inadvertenly omitted to be mentioned.
Ld. Counsel for the plaintiff submits that he has no
objection if amendment sought for is allowed, being
technical/legal in nature, but subject to some cost.
Considering the same, amendment sought for by the
defendant, being technical/ legal in nature, is hereby allowed,
subject to cost of Rs.2,000/- to be paid to the plaintiff.
Accordingly, application under Order VI Rule 17 CPC, as moved
by the defendant, stands allowed. Amended written statement, as
filed by the defendant is taken on record.
Both the parties seek adjournment for arguments on
application under Order XII Rule 6 CPC.
Considering the same, put up for arguments on
application under Order XII Rule 6 CPC and payment of cost of
Rs.2,000/- by defendant to plaintiff on 20.07.2024.
