File taken up today on an application moved by counsel for
the appellant/accused for preponment of next date of hearing.
Pr. Sh. Mohd. Shahjan Islam and Sh Dinesh Yadav, Ld.
Counsels for the appellant.
He submits that trial Court of Ms. Pooja Yadav, Ld. M.M. has
taken the accused into custody today. He submits that appellant is
ready to abide by the orders of this Court.
The order on sentence is dated 24.03.2023. As per the
confirmation made by the Naib Court, the appellant has been taken
into custody by Ld. Trial Court.
In view of the facts and circumstances, subject to the
appellant depositing 40% of the cheque amount within 60 days from
today before the learned Trial Court, the operation of Judgment dated
27.02.2023 and order on sentence dated 24.03.2023 are stayed till
disposal of the appeal.
The appellant is admitted to bail on furnishing personal
bond / surety bond in the sum of Rs.50,000/- subject to satisfaction of
Ld. Trial Court. The appellant is directed to submit personal bond /
surety bond before the Ld. Trial Court.
Notice of the appeal be issued to the respondent on
filing PF / RC returnable on 06.06.2023. Date given earlier i.e.
23.05.2023 stands cancelled.
Trial Court record be summoned for the next date of
hearing.
A copy of this order be sent to the Ld. Trial Court for
information and compliance.
