Separate statement of ld. counsel recorded. It is stated by
ld. counsel that as per instructions JD is presently in jail in present case
after conviction in a case under section 138 of NI Act. The decree
could not be satisfied from the attachment of bank account of JD. Ld.
counsel stated that as per instructions, he may be permitted to withdraw
this application with liberty to file fresh as and when movable and
immovable property of JD will be traced.
In view of statement of ld. counsel for the DH, execution
petition is dismissed as withdrawn with liberty to file fresh at the
appropriate stage.
Original documents of party, if any, be returned after
taking certified copy of the same on record.
File be consigned to record room after due compliance.
