Present : Mr. Abhishek Sharma, Ld. Counsel for applicant
along-with the applicant.
Steps not taken by the applicant in compliance of order
dated 16.01.2025.
Ld. Counsel for the applicant submits that the probate
petition bearing PC No.19/2018 was allowed vide order dated
12.12.2019 and accordingly, probate certificate was ordered to be
issued in respect of properties bearing no. 62-B, Kundan Nagar,
Laxmi Nagar, Delhi; 184, Khureji Khas, Delhi and Prachin Bam
Mahadev Mandir, Bank Enclave, Laxmi Nagar, Delhi.
Ld. Counsel for applicant further submits that a partition
suit is pending before the Hon’ble High Court of Delhi in respect of
the property at Prachin Bam Mahadev Mandir, Bank Enclave, Laxmi
Nagar, Delhi and prayed that probate certificate be issued in respect of
properties bearing no.62-B, Kundan Nagar, Laxmi Nagar, Delhi and
184, Khureji Khas, Delhi.
Ld. Counsel for the applicant seeks some time to file
citations in support of his contentions.
Court fees of Rs.80,280/- filed on behalf of the
applicant. The same is taken on record.
Ld. Counsel for the applicant also seeks some time to
file the deficient Court fees after filing of valuation report by the
concerned SDM.
At request of Ld. Counsel for applicant, put up for
further proceedings on 17.07.2025.
