SUNIL KUMAR SONI Vs. Priyanka Chadha
13.04.2026
Pr. Sh. Jagdeep Anand and Sh. Archit Aggarwal, ld. Counsels
for DH.
Sh. Satish Sharma, Ld. Counsel for JD No.1.
Sh. Prashant Kumar Sharma, Ld. Counsel for JD No.2
along with Sh. Abhishek Tyagi, Manager, BSES.
The present execution petition is filed with respect to order
dated 08.01.2024, whereby Ld. Predecessor had granted liberty to the
DH to apply and obtain an independent/individual/ exclusive
electricity connection from Discom concerned and only in accordance
with the extant rules applicable in this regard without a formal no
objection from the defendant.
DH, firstly, applied for electricity connection at the fourth floor
and the said application was dismissed by BSES on the ground that
the there is no fourth floor in the property in question. The admitted
position which emerges from the submissions of Ld. Counsels for the
parties is that there is parking/ground floor, upperground floor, first
floor, second floor and third floor/top floor with roof constructed at
the property in question. DH states that he is in possession of the third
floor/top floor of the property in question which is disputed by Ld.
Counsel for JD No.1 who submits that the licensee of JD No.1,
namely, Sh. Arun Paswan is in possession of the said floor. DH
claims, Sh. Arun Paswan is his caretaker and is in possession of the
third floor/top floor through him. Thus, it stands admitted that Sh.
Arun Paswan is in possession of third floor/top floor of the property,
and the electricity connection is required at the third floor of the
property in question.
Ld. Counsel for JD No.2/BSES submits that a fresh electricity
connection in the name of DH cannot be installed at the third floor/top

floor as the electricity connection bearing CA No. 153939363, meter
No. 55431054 is already in existence at the third floor which is in the
name of JD No.1/Ms. Priyanka Chaddha. He further submits that a
fresh electricity connection in the name of DH cannot be installed
without disconnection of existing electricity connection, which is in
the name of JD No.1/Ms. Priyanka Chaddha, in terms of Regulation
10 (1)(vi) of Chapter3 of DERC (Supply Code and Performance
Standards) Regulations, 2017.
It is mutually agreed between DH and JD No.1 that without
prejudice to the rights and contentions of the parties, JD No.1/Ms.
Priyanka Chaddha will supply electricity to DH through submeter
subject to payment of regular electricity dues with respect to CA No.
153939363, meter No. 55431054. It is further agreed that the payment
of electricity dues would be made regularly by DH into the bank
account of JD No.1/Ms. Priyanka Chaddha through online/e
mode/netbanking, except in cash. They have further agreed that JD
No.1 will provide her bank account details to the DH and will also
