Heard.
It appears that the mediation settlement, dated 13.05.2025, be
tween the parties does not speak about the directions, if any, to be is
sued, however, the suit is one for declaration and cancellation and the
parties have already settled the matter, therefore, in order to subserve

the ends of justice, I hereby pass a decree of declaration, declaring that
the sale deed, dated 08.08.2018 (regn. on 23.08.2018), Registration
No. 4904. In Addl. Book No.1, Volume No. 1370, on pages 7281,
registered on 23.08.2018 with S.R. VIIIA, Delhi, in respect of prop
erty bearing number built up entire third floor with exclusive roof/ter
race rights, a part of immovable property, bearing No. F44/770, (built
up on plot 770), area measuring 67 sq. yards, i.e., 56.01 sq. mtr., out
of khasra No. 305/212, situated in the abadi of Ganesh NagarII,
Shakarpur, Delhi110092 as mentioned in para 7 of the suit as null and
void; Also, a decree of mandatory injunction thereby directing the de
fendant no to use the above Sale Deed in any manner whatsoever,
with a further direction to the SubRegistrar, concerned to cancel the
sale deed as above within a period of three months and send compli
ance report to this Court. Ahlmad is directed to send the direction, ac
cordingly. Plaintiff shall be entitled for the refund of the court fees, as
per rules.
Decreesheet be prepared accordingly. File be consigned to
Record Room.
