Counsel for the appellant submits that a petition has
been moved before Hon’ble High Court of Delhi challenging the
order dated 23.11.2024, whereby the application of the appellant
under Section 391 CrPC for adducing additional evidence was
dismissed and the appellant has filed the copy of the said order.
Vide its order dated 16.12.2024, Hon’ble High Court
of Delhi has issued the notice to the opposite party on the
application to stay the proceedings of the instant appeal and now,
the matter is listed on 12.02.2025.
In the instant appeal, final arguments have already
been addressed by the parties and proceeding further with the
appeal, at this juncture, would make the aforesaid application
infructuous.
Therefore, considering the judicial propriety, the
matter be put up for further proceedings/clarification/
consideration on 24.02.2025.
Copy of this order be given dasti to the respondent
no. 2, as prayed for.
