IO is apprised that the CD filed on record alongwith
the charge sheet cannot be played on the computers of court room.
Ahlmad reported that as per list of documents, the
charge-sheet is complete.
Briefly stated facts of the case are that on 09.02.2010
complainant Mohd. Umar gave a written complaint regarding demand
and taking of bribe by Virender Singh – Patwari, Jagminder Singh –
Kanungo of Land and Estate Department of MCD and Ashok Kumar –
Kanungo of Slum and JJ Department of MCD from the complainant
Mohd. Umar and his son Irshad for moving file of complainant Mohd.
Umar for allocation of land on lease by MCD to Sitarey Hind Health
Club for running a health club. Irshad, son of complainant, recorded the
demands and acceptance of the bribe through video camera.
On the basis of complaint of complainant Mohd. Umar
present case FIR was registered and investigation conducted. Accused
Virender Singh – Patwari expired on 08.10.2018 and the complainant
Mohd. Umar had also expired on 12.03.2020. Sanction to prosecution
u/s 19 of POC Act was obtained against accused Jagminder Singh and by
way of supplementary charge-sheet sanction for prosecution u/s 19 of
POC Act against accused Ashok Kumar, was filed.
Accused Jagminder Singh and Ashok Kumar have been
charge-sheeted for offences u/s 7/13 Prevention of Corruption Act r/w
Section 120-B IPC.

In view of the investigation conducted, the complaint of
the complainant Mohd. Umar, statements of witnesses, FSL reports,
sanction u/s 19 of POC Act and material available on record, I take
cognizance of the offences u/s 7/13 of Prevention of Corruption Act,
1988 r/w Section 120B IPC against the accused Jagminder Singh and
Ashok Kumar. As per charge-sheet, accused Jagminder Singh and Ashok
Kumar are on bail in this case.
Accused Jagminder Singh and Ashok Kumar be
summoned for the next date of hearing.
List the case for appearance of accused persons on
01.06.2024.
