Present : Ld. Counsel for petitioner.
Mr. B. Khan, Ld. Counsel for respondent. (through VC)
Cost imposed upon the respondent vide order dated 19.08.2025 has not
been paid yet to the petitioner. Let it be paid during the course of the day and receipt/proof
of payment be filed, failing which cost shall be enhanced to Rs.8000/- to be paid by the
respondent.
An application filed by the respondent under Order VII Rule 11 CPC is
pending adjudication. Reply is already on record.
Ld. Counsel for respondent has
inter-
alia submitted that the tenanted
premises i.e. half portion of first floor backside of H. No. 148, Katra Gokul shah, Bazar
Matia Mahal, Jama Masjid, Delhi-110006, consisting of two rooms, one store room,
covered
verandah, kitchen with facility of latrine and bathroom, etc., falls in the notified
slum area and admittedly, the petitioner has not obtained any permission from the Ld.
Competent Authority under Section 19 of the Slum Areas (Improvement and Clearance)
Act, 1956.
On the other hand, Ld. Counsel for petitioner submits that the tenanted
premises do not fall under a notified slum area and hence, no permission is required to be
obtained by the petitioner.
Respondent/applicant is directed to file relevant notification/documents to
show that tenanted premises in question falls under the notified slum area under the
aforesaid Act.

Ld. Counsels for both the sides are expected to remain present in person on
the NDOH.
